The questioner : In his first question, he asks for an interpretation of this noble verse. Allah the Exalted said:
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers. ومن لم يحكم بما أنزل الله فأولئك هم الكافرون
[Al-Ma'idah 5:44]


The Shaykh : Allah the Exalted clarifies in this verse that a person who does not judge by what Allah has revealed is a disbeliever. This is because he has turned away from the Book of Allah and what He revealed to His messengers, turning instead to the judgment of a taghut that contradicts the Shari'ah of Allah. However, according to the texts, this is qualified by the condition that the one who judges by other than what Allah has revealed believes that his judgment is better than the judgment of Allah the Mighty and Majestic, more beneficial for the servants, and more appropriate for them, and that the judgment of Allah is not suitable for judging between the servants. If he holds this view, he becomes a disbeliever in a way that takes him out of the religion. But if he judges by other than what Allah has revealed out of following his desires, with the intention of harming the one against whom judgment is passed, or out of favoring the one in whose favor judgment is passed, or the like of that, then his disbelief is a lesser disbelief that does not take him out of the religion. This is because he has not replaced the judgment of Allah with another out of disdain for the judgment of Allah and a desire to turn away from it, or out of the belief that another is better. Rather, he did this for a reason within himself, whether to favor a relative, to harm an enemy, or something similar. The important point is that this issue requires detailed explanation.
