The questioner : This questioner says: I am asking about the noble verse in the statement of Allah, Blessed and Exalted is He:
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers. ومن لم يحكم بما أنزل الله فأولئك هم الكافرون
[Al-Ma'idah 5:44]
. To whom does this noble verse apply? May you be rewarded.

The Shaykh : Praise be to Allah, Lord of the worlds. May Allah send blessings and peace upon our Prophet Muhammad, and upon his family and all his Companions, and upon those who follow them in excellence until the Day of Judgment.
It was said that this verse was revealed regarding the Jews, and these people argued that it was in the context of rebuking the Jews. Allah the Exalted said:
Indeed, We sent down the Torah, in which was guidance and light. The prophets who submitted [to Allah] judged by it for the Jews, as did the rabbis and scholars by that with which they were entrusted of the Scripture of Allah, and they were witnesses thereto. So do not fear the people but fear Me, and do not exchange My verses for a small price. And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers. إنا أنزلنا التوراة فيها هدى ونور يحكم بها النبيون الذين أسلموا للذين هادوا والربانيون والأحبار بما استحفظوا من كتاب الله وكانوا عليه شهداء فلا تخشوا الناس واخشون ولا تشتروا بآياتي ثمنا قليلا ومن لم يحكم بما أنزل الله فأولئك هم الكافرون
[Al-Ma'idah 5:44]

Some said that it is disbelief less than disbelief, and this is narrated from Ibn Abbas (may Allah be pleased with him and him), and it is like the statement of the Prophet (peace and blessings be upon him):
Abusing a Muslim is an outrage and fighting against him is unbelief سباب المسلم فسوق، وقتاله كفر
Sahih Muslim 64a
. This is disbelief less than disbelief, as evidenced by the statement of Allah the Exalted:
(9) And if two factions among the believers should fight, then make settlement between the two. But if one of them oppresses the other, then fight against the one that oppresses until it returns to the ordinance of Allah. And if it returns, then make settlement between them in justice and act justly. Indeed, Allah loves those who act justly. (10) The believers are but brothers, so make settlement between your brothers. And fear Allah that you may receive mercy. وإن طائفتان من المؤمنين اقتتلوا فأصلحوا بينهما فإن بغت إحداهما على الأخرى فقاتلوا التي تبغي حتى تفيء إلى أمر الله فإن فاءت فأصلحوا بينهما بالعدل وأقسطوا إن الله يحب المقسطين ، إنما المؤمنون إخوة
[Al-Hujurat 49:9-10]
. Thus, Allah the Exalted made the two warring groups brothers to the third group that reconciles them. This is the fighting of a believer against a believer, so it is disbelief, but it is disbelief less than disbelief.
It was said that the statement of Allah the Exalted:
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers. ومن لم يحكم بما أنزل الله فأولئك هم الكافرون
[Al-Ma'idah 5:44]
applies to a man who judges by other than what Allah has revealed without figurative interpretation, while knowing the ruling of Allah, Mighty and Majestic, but he judges by other than what Allah has revealed believing that it is like what Allah has revealed or better than it. This is disbelief, because he replaced the religion of Allah with other than it.
