Q: On Thursday, corresponding to 25/9/1421 AH, we headed to Makkah via the Siyal road , and we entered the state of ihram from there. Then we headed to the Haram , and it was approximately 4:30 in the afternoon. When we entered through the King Abdulaziz Gate to begin the tawaf, there was a heavy crowd. My wife and my sons were with me: one was 5 years old, the second was 4 years old, and the third was 8 months old. Also with us was the Indonesian (Muslim) domestic worker. We put our 5-year-old son and our 4-year-old son into ihram. When we saw the crowd, we preferred to remain until we saw an opportunity for tawaf. However, the crowd intensified more and more throughout that night. After the Fajr prayer, we attempted the tawaf, but it was such that my family and I could not descend [to the lower level]. Then I descended and left my family, and I completed my 'Umrah. I had to remain with the small family members, and my wife and the worker were to descend. But when they saw the crowd, they preferred to remain. We sat and waited until 9:30 in the morning on Friday, corresponding to
26/9/1421 AH, and the crowd continued. Due to the increased exhaustion of all my family members from staying up all night, and also the lack of food supplies for the children, the family insisted on returning to take a rest. This led us to leave the Haram without performing the 'Umrah for my wife, the remaining children, and the worker. We returned to Riyadh . I hope you will give us a fatwa on this matter, and may Allah reward you with good.
A: If the situation is as described, then those who did not complete the 'Umrah must renew their ihram garments and return to Makkah as soon as possible to perform the 'Umrah for which they entered ihram but did not perform its rites. If you had intercourse with your wife during this period, her 'Umrah is invalid. She must continue with this invalid 'Umrah, then return to the miqat from which she originally entered ihram, and enter ihram for a new 'Umrah to make up for the invalid one. She must also slaughter a sheep in Makkah that is acceptable as an 'Id sacrifice, distribute it to the poor of the Haram, and pay a fidyah for the intercourse. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
