Fatwa No. ( 21687 )
Q: Five years ago, my son and I performed 'Umrah, and he was young at the time. We encountered a severe crowd, as it coincided with the 26th of Ramadan, and we circumambulated the Ka'bah, but we were unable to perform the Sa'y and returned to Jazan . After the festival, I returned alone and completed the 'Umrah. I should note that after my first return, I had intercourse with my wife that is: before making up that 'Umrah. What is obligatory for me and my son?
A: First: It is obligatory for your son, who did not complete the 'Umrah, to put on the ihram garments again and hasten to return to Makkah to complete his 'Umrah by performing the Sa'y and shortening the hair. Second: It is obligatory for you to return to Makkah and enter the state of ihram for a second 'Umrah from the miqat from which you entered ihram for the 'Umrah that you invalidated through intercourse, and to perform a complete 'Umrah as a make-up for the invalid 'Umrah. It is also obligatory for you to slaughter a sheep that is acceptable for the 'Id sacrifice and distribute it to the poor of the Haram. If you are unable to do so, you must fast for ten days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
