Q: One of my companions went with his mother and his wife to Makkah to perform 'Umrah. They all entered the state of ihram from the miqat. When his mother reached the Haram, she said, "Give me the children so I can sit with them, and you and your wife can go perform the 'Umrah." She did not perform the 'Umrah. Is there anything required of her regarding this matter, which occurred in the month of Rajab, 1416 AH? And if her husband had intercourse with her, what is required of her? May Allah reward you with good.
A: If the situation is as described, it is obligatory for the woman to adhere to the rulings of ihram and avoid its prohibitions, because she is still in the state of ihram for 'Umrah. Then she goes to Makkah and performs the 'Umrah for which she entered ihram, because one who enters ihram for a pilgrimage is required to perform it
and it is not permissible for him to refuse it; as Allah the Exalted said:
And complete the Hajj and 'umrah for Allahوَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ
[Al-Baqarah 2:196]
And if her husband had intercourse with her during this period, her 'Umrah has become invalid, and she is required to continue with it and complete it by performing tawaf, sa'y, and shortening the hair. Then she returns to the miqat from which she entered ihram for the first 'Umrah that was invalidated by the intercourse, and she enters ihram from there for another 'Umrah to make up for the 'Umrah she invalidated with the intercourse, and then she performs it completely. She must also pay an expiation, which is slaughtering a head of sheep that is acceptable for the 'Id sacrifice, to be slaughtered in Makkah and distributed to its poor. If she cannot find one, she fasts for ten days for invalidating the 'Umrah with intercourse, along with repentance to Allah (Glorified and Exalted is He) for what she did. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
