Praise be to Allah alone, and peace and blessings be upon the Prophet after whom there is no Prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Mufti from the inquirer / the preachers at the Pilgrims Building in Jeddah Airport , through the Office Manager / Ali ibn Yahya al-Hakami , and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number « 6962 » on 11\11\1421 AH. The inquirer asked a question, the text of which is: The workers belonging to the office tasked with transporting the luggage of the pilgrims come from al-Sham for the purpose of working at the airport and performing Hajj, and were they not for Hajj, they would not have come. However, their employer does not allow them to enter the state of ihram and go to the Noble Makkah except on the seventh day of Dhul-Hijjah, and they come from the beginning of Dhul-Qa'dah. Are they required to return to the miqat, or do they have the ruling of a resident in Jeddah ? It is known that some of them come with the intention of performing Hajj alone (ifrad), and it is difficult for them to remain in the state of ihram for the entire period.
After the Committee studied the inquiry, it answered: If these mentioned individuals came to Jeddah with the intention of working only, and then it occurred to them to perform Hajj while they were in Jeddah , then they enter the state of ihram from the place from which they intended to perform Hajj, which is Jeddah . But if they came with the intention of working and performing Hajj together, then they are required to return to the miqat that they passed on their arrival, and enter the state of ihram from it; due to the saying of the Prophet (peace and blessings be upon him) regarding the miqats:Sahih Muslim 1181a . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
