A : A statement has previously been issued by His Eminence the Grand Mufti regarding the aforementioned book. The text of the statement is as follows: Praise be to Allah, Lord of the worlds, and may blessings and peace be upon our Prophet Muhammad, and upon his family and all his Companions. After that: The Messenger of Allah (peace and blessings be upon him) specified the miqats for entering the state of ihram, which it is not permissible for anyone passing through them intending Hajj or 'Umrah to pass without entering ihram. They are: Dhul-Hulayfah , Abwar 'Ali : for the people of Madinah and those who come via their route. Al-Juhfah : for the people of Sham and Egypt and the Maghreb and those who come via their routes. Yalamlam (Al-Sa'diyyah): for the people of Yemen and those who come via their routes. Dhat 'Araq : for the people of Iraq and those who come via their routes. Qarn al-Manazil : for the people of Najd and Ta'if and those who come via their routes. Whoever resides below these miqats in the direction of Makkah enters ihram from his residence, even the people of Makkah enter ihram from Makkah for Hajj, whereas for 'Umrah they enter ihram from the nearest point of the permissible area (Hill), just as the people of Jeddah and those residing there enter ihram from Jeddah , if
they intend Hajj or 'Umrah. Whoever passes through these miqats coming to Makkah and does not intend Hajj or 'Umrah, it is not obligatory for him to enter ihram according to the correct opinion. However, if he decides to perform Hajj or 'Umrah after passing them, he enters ihram from the place where he intended Hajj or 'Umrah, unless he intends 'Umrah while in Makkah , in which case he goes out to the nearest point of the permissible area (Hill) and enters ihram - as mentioned before. Thus, entering ihram is obligatory from these miqats for everyone who passes through them or passes alongside them by land, sea, or air, and intends Hajj or 'Umrah. The reason for publishing this statement is that a booklet titled “Evidence Proving that Jeddah is a Miqat” has recently been issued by some of the brothers, in which the author attempts to establish an additional miqat beyond the miqats specified by the Messenger of Allah (peace and blessings be upon him). He assumes that Jeddah would be a miqat for those arriving at its airport by plane, or those arriving by sea or land, so that all these people can delay entering ihram until they reach Jeddah and enter ihram from there; because, in his claim and estimation, it is alongside the miqat of Al-Sa'diyyah and Al-Juhfah , so it is a miqat. This is a clear error known to anyone with insight and knowledge of reality; because Jeddah is inside the miqats, and the one coming to it must pass through one of the miqats specified by the Messenger of Allah (peace and blessings be upon him) or pass alongside it by land, sea, or air, so it is not permissible for him to pass it without entering ihram if he intends Hajj or 'Umrah; due to the saying of the Messenger of Allah (peace and blessings be upon him) when he specified these miqats:Sunan al-Bayhaqi 4:296 Therefore, it is not permissible for the pilgrim and the one performing 'Umrah to cross these miqats to Jeddah without entering ihram, and then enter ihram from there; because it is inside the miqats. When some scholars hastened a few years ago to what the author of this booklet hastened to, and issued a fatwa that Jeddah is a miqat for those coming to it, the Council of Senior Scholars issued a decision to invalidate and refute this claim. It stated: After referring to the evidence and what the scholars of practice mentioned regarding the spatial miqats, and discussing the topic from all its angles, the Council decides unanimously as follows: 1 – The fatwa issued specifically regarding the permissibility of making Jeddah a miqat for airplane and ship passengers is an invalid fatwa; because it is not based on a text from the Book of Allah or the Sunnah of His Messenger, or the consensus of the Salaf of the Ummah, and no scholar of the Muslims whose opinion is considered has preceded him in this. 2 – It is not permissible for anyone who passes through one of the spatial miqats or passes alongside one of them by air, land, or sea to pass it without entering ihram, as the evidence testifies to this, and as the scholars (may Allah have mercy on them) have established, if he intends Hajj or 'Umrah. Out of the obligation to advise Allah and His servants, I and the members of the Permanent Committee
