Q: I travel frequently to Jeddah during all school holidays for treatment, leisure, and visiting relatives, and I have a house there. In every one of those trips, I perform an 'Umrah and enter the state of ihram, either from the miqat or from Jeddah after staying there
for a week or more or less. Over these years, the number of people in my family has become thirteen, so I no longer enter ihram except from Jeddah . Some of my brothers have permitted this for me, while others have criticized it, knowing that my intention is to perform 'Umrah after sitting in Jeddah for some time

A : If one comes to Makkah intending to perform 'Umrah or Hajj and passes by one of the miqats designated by the Messenger of Allah (peace and blessings be upon him), it is not permissible for him to pass beyond it without entering the state of ihram, even if he intends to go to Jeddah or elsewhere before performing the rites. If he passes the miqat in this case and enters ihram from a place beyond it, he must offer a sacrificial animal, which is a fidyah slaughtered in Makkah and distributed to the poor of the Haram . If he is unable to slaughter the fidyah, he must fast for ten days. If he comes to Makkah not intending to perform 'Umrah, and then after passing the miqat he decides to perform 'Umrah, he enters ihram from the place where he made that intention, whether it is from Jeddah or from elsewhere that is beyond the miqat. Therefore, you are required to offer a fidyah for passing the miqat without entering ihram while intending to perform 'Umrah, every time that occurred on your part. Likewise, the fidyah is required from any member of your family who did what you did. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
