Praise be to Allah, and may peace and blessings be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the honorable Shaykh Saleh al-Atrem, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number « 5473 » and date 27/12/1414 AH. His eminence asked about one who entered the state of ihram for Hajj, then changed it to 'Umrah before performing Hajj, and returned to his country without performing Hajj .
After studying the inquiry, the Committee answered that one who enters the state of ihram for Hajj alone, or for both Hajj and 'Umrah, and then changes the Hajj or the combined intention to tamattu' (combining 'Umrah and Hajj with a break between them), is not permitted to leave Hajj. Rather, it is obligatory for him to perform Hajj in that same year; because by entering the state of ihram for Hajj alone or with 'Umrah, he has obligated upon himself the completion of Hajj. This is based on the saying of Allah, the Exalted and Glorious:[Al-Baqarah 2:196] , and the permission for him to change to 'Umrah does not drop the obligation of Hajj from him. Rather, by doing so, he obtains ease and facilitation, and the performance of each rite, namely 'Umrah and Hajj, in their complete form. If he does not perform Hajj in his year, it becomes obligatory for him to perform Hajj in the coming year, along with repentance to Allah for delaying it, unless he has a valid legal excuse that necessitated the delay.
The Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) said in *Majmu' al-Fatawa*, vol. 26, p. 58: “If the one in the state of ihram for Hajj alone wishes to cancel his Hajj and make it an independent 'Umrah, it is not permissible without dispute; rather, cancellation is only permissible for the one whose intention was to perform Hajj after 'Umrah.” End of quote. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
