Who intended to perform Hajj ifrad, then changed his intention to 'Umrah, and entered the state of ihram for Hajj on the eighth day: is a sacrificial animal required of him?

Machine translationRead the Arabic original
The questioner : The Sunnah: These are my children performing Hajj with me, one is eleven years old and the other is thirteen. I took them on the fifth of Dhu al-Hijjah and had them sit in Makkah. I told them, "Sit here in the state of ihram, do not go right or left, and fulfill your obligations." I then returned to 'Afiyah.

Another questioner : They were performing ifrad.

The questioner : They were performing ifrad, and while I was in 'Afiyah, they went down to Makkah, removed their ihram, performed tawaf and sa'y, and removed their ihram.

Another questioner : And they shortened their hair afterwards.

Another questioner : And they shortened their hair.

Another questioner : The question...

The questioner : Is anything required of them?

Another questioner : A sacrificial animal?

The questioner : A sacrificial animal?

The Shaykh : Like that, do we need to work on it, hehe...

The questioner : ... .

The Shaykh : I am thinking, I did not understand the question, then the news came, is anything required of them? Okay, I really did not clarify for me if there was a mistake, so I asked if anything is required of them or not? What is the mistake you imagine?

The questioner : ... Is a sacrificial animal required of these boys?

The Shaykh : You are saying you performed Hajj ifrad...

The questioner: Yes.

The Shaykh : Okay, the sacrificial animal is for the mutamatti' or the qarin...

The questioner : They did not remove their ihram, they took an 'Umrah, performed tawaf, removed their ihram, and exited the state of ihram.

Another questioner : They did the Sunnah.

The Shaykh : When did they exit the state of ihram, my brother?

The questioner : On the seventh day.

Another questioner : From the fifth day.

The Shaykh : Ah...

The questioner : From the fifth day, the day I left them, they went down to Makkah, performed tawaf and sa'y, shortened their hair, and returned to their tent.

The Shaykh : Okay, you did not mention when they exited the state of ihram?

The questioner : ... .

The Shaykh : This is a problem...

The questioner : Keep going, complete it for him.

The Shaykh : Okay, you are writing these questions...

The questioner : No, this is it, we were with him in Hajj, he was asking and we knew the issue.

The Shaykh : I mean, your question should be complete so that I can understand it.

The questioner: Yes.

The Shaykh : And it becomes easy for me to answer it. So now, these people, they performed 'Umrah even though they had intended Hajj ifrad, is that right?

The questioner: Yes.

The Shaykh : Up to here...

The questioner: Peace be upon you.

The Shaykh-And upon you be peace, and Allah's mercy and blessings - After they performed the 'Umrah, they exited the state of ihram naturally, then what happened after that? Ah...

The questioner : They sat in Mina.

The Shaykh : Yes, and they completed the Hajj?

The questioner: Yes.

The Shaykh : And they performed tawaf al-ifadah, how?

The questioner : On the eighth day, they entered the state of ihram and went out, everything was fine, his father came.

The Shaykh : My brother, the word "covered" may Allah guide you, did he perform tawaf al-ifadah? Yes, yes?

The questioner : They performed the complete Hajj.

The Shaykh : Okay, and what did their father do?

The questioner : ... .

The Shaykh : He, regarding his Hajj, what did he do?

The questioner : I did.

The Shaykh : Or me? What did you do, my brother?

The questioner : I performed Hajj ifrad.

The Shaykh : Okay, the boys performed Hajj better than their father's Hajj. They truly, without prior jurisprudence, brought the Sunnah. As for their father, he opposed the Sunnah, indeed he opposed the obligatory, because the sons changed their Hajj to 'Umrah, and that is what the Messenger (peace be upon him) ordered in the Farewell Pilgrimage in two stages or in two different times. It is only established in the authentic hadiths that when the Prophet (peace and blessings be upon him) performed the Farewell Pilgrimage, and thousands of his Companions performed it with him, they were of three types: some were performing ifrad, some were performing tamattu', and some were performing qiran. These qarin divided into two groups in terms of their actual situation: some brought the sacrificial animal from Dhu al-Hulayfah, and some did not bring the sacrificial animal. With this last division, the types of pilgrims with the Messenger became four: ifrad, qarin who brought the sacrificial animal, qarin who did not bring the sacrificial animal, and mutamatti'. Four types. And they continued to chant the talbiyah for their Hajj, all of them, until they descended to a campsite among those campsites. The Messenger (peace be upon him) preached to them and taught them some of the rituals of Hajj, and among what he said to them was:
Whoever among you has not brought the sacrificial animal and wishes to make it an 'Umrah, let him do so. مَن كان منكم لم يسُقِ الهديَ وأحبَّ أن يجعلَها عمرة فليفعَلْ
, and I ask you to pay attention now to his saying (peace and blessings be upon him): that he specifically mentioned those who had not brought the sacrificial animal first, then he said:
And whoever wishes to make it an 'Umrah, let him do so. وأحبَّ أن يجعَلَها عمرة فليفعَلْ
Sahih Ibn Hibban 15:108
, so he returned the exiting of the state of ihram through 'Umrah from Hajj or from qiran without a sacrificial animal to the desire of the person obligated, and they proceeded with that until they reached Makkah. And there, before entering Makkah - there is no need, my brother -.
The student : ... .

The Shaykh-There is no need, may Allah bless you - There, before entering Makkah, he preached to them the same sermon, but he did not say:
and likes to make it as `Umra, he should do it مَن أحبَّ أن يجعلَها عمرة فليفعَلْ
Sahih al-Bukhari 1788
, but rather he said:
Whoever among you has not brought the sacrificial animal, let him make it an 'Umrah. مَن كان منكم لم يسُقِ الهديَ فليجعَلْها عمرة
,
Let him make it an 'Umrah فليجعَلْها عمرة
, so the Messenger (peace be upon him) gradually moved the people from Hajj ifrad to tamattu' at the beginning by way of choice, so as not to surprise them with what was not in their expectations. For it was, as established in some authentic hadiths, one of the most disliked things among them for a person to perform 'Umrah in the months of Hajj. So the Messenger (peace be upon him) abolished this custom in some authentic hadiths, and this portion is now before us as we mentioned. So before entering the Sacred Mosque, he said to them:
So whoever among you has not brought sacrificial animals, let him make it an 'Umrah فمَن كان منكم لم يسُقِ الهديَ فليجعَلْها عمرة
. Despite all this, when the Messenger (peace and blessings be upon him) performed tawaf and sa'y and exited the state of ihram - and he did not exit the state of ihram because he was a qarin - likewise, those who had intended qiran did not exit the state of ihram. When the Messenger (peace be upon him) saw them, the matter was difficult for him, so he said to them:
O people, exit the state of ihram. If it were not that I have brought sacrificial animals, I would have exited the state of ihram with you يا أيها الناس ، أحلُّوا ، فلولا أني سُقْتُ الهديَ لَأحلَلْتُ معكم
. Jabir, the narrator of the hadith, said:
The incense burners were lit, we exited the state of ihram, and we went to our wives فسطعت المجامر ، وتحلَّلْنا ، وأتينا النساء
; and therefore, the blessed boys did a good deed and responded to the command of the Messenger (peace be upon him). And thus, it is obligatory for every pilgrim, whether he intended Hajj ifrad or intended Hajj qarin without bringing the sacrificial animal from the state of ihram, and this is the majority of pilgrims today. It is very rare, very rare, for someone to bring the sacrificial animal from the state of ihram, except some Bedouins or some Arabs, and this is known about them. But people like us, Jordanians and Syrians, let alone those who are farther...

The questioner : They come by airplanes.

The Shaykh : Ah, so they do not bring the sacrificial animal. Therefore, these people must perform 'Umrah before Hajj and exit the state of ihram, then on the eighth day they chant the talbiyah for Hajj where their campsite was, and they are required to offer the sacrificial animal afterwards. Perhaps you offered a sacrifice on behalf of your sons?

The questioner: No, no.

The Shaykh : This is a problem, hehe, this was not the question, but I answered without a question, hehe...

The questioner : Did they fast? Did they fast? Did they fast?

The Shaykh : Even if they fasted. Because it is not by direction...

The questioner : What is the action now, my Shaykh?

The Shaykh : By Allah, I do not know - And upon you be peace, and Allah's mercy and blessings - It needs, it needs a little thinking - And upon you be peace, and Allah's mercy and blessings, complete it, Doctor, complete it, yes -.
