Q: I submit to your honor that my father is advanced in age, he is bedridden at home, and he has money in the bank. He is very forgetful. These amounts are subject to zakah . When asked about its zakah, he says that he has paid it, but due to my access to his accounts, I know that he has not paid the obligatory zakah. I am responsible for many of his affairs, and I am able to pay his zakah. Is it permissible for me to do so without his knowledge and without his consent, or what should I do? Please issue a ruling, may Allah reward you, and may Allah reward you with good.
A: If you have a legal agency (wakalah) to manage your father's wealth, then it is obligatory for you to pay its zakah on his behalf. If you do not have an agency, then it is obligatory for you to go to the Sharia court to obtain a legal agency to dispose of his wealth in a way that grows it and preserves it, and to pay its zakah. May Allah guide everyone to what is good and right. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
