Q: My mother passed away, may Allah shower her with abundant mercy, and she left behind a sum of money. All the heirs, who are adults and include no minors, have waived their shares in this estate. They have all agreed to spend it on acts of charity with the intention of it being on behalf of my mother, may Allah have mercy on her. My mother used to pay zakah on this money every year—the money she had accumulated throughout her life—but we, the children, have doubts about the zakah my mother paid on this money. Was the amount she paid out as zakah on this money correct at 2.5%, or did she pay an approximate amount? How should we pay zakah on this money that is in our hands, and for how many years should we pay zakah on it before we spend it on acts of charity?
A: If the situation is as you described, that you all agreed, with no minors among you, to devote what your mother left behind to the path of righteousness—then
there is no zakah on it. And the doubt you mentioned regarding how your mother paid zakah on this money during her lifetime has no effect, and nothing is required of you in this regard. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
