Q: I have a full brother who has a debt. Is it permissible to give him zakah, knowing that the zakah is not my personal zakah, but rather the zakah of some charitable people? If the answer to the previous question is yes, is it permissible for me to reclaim the amounts I paid him to settle the debt? Knowing that I paid him from my own money to free him from legal pursuit by the creditors.
A: If your brother is in debt and unable to pay the debt he is being demanded to pay, it is permissible to give him zakah, whether from your personal zakah, which is the correct opinion among the scholars, or from the zakah of those who entrusted you with its distribution. As for what you gave your brother to free him from his debts, if it was with the intention of zakah before payment, then it is lawful zakah; and if it was without the intention of zakah, then it is voluntary charity. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
