The second question of Fatwa No. ( 10652 )
Q2: If a man dies, it is said: It is not permissible for his wife to look at a picture of her husband, nor to touch him, and likewise for the husband. If the wife insists on seeing a picture of her husband, they should answer her: You are outside the scope of the contract, why do you look at him? And if someone dies and is not handed over to the grave, and a cloth is placed over the eyes of his wife, and she is sent to her father's house to complete her waiting period there, meaning: that the waiting period and leaving the house during the waiting period is forbidden for her, and the marital home exists, yet she is sent to her father's house. Is this permissible, and is it correct that the wife does not look at her husband's body after his death, and likewise the husband? And is it permissible for the wife during the waiting period to go to
her father's house, her mother's house, or other relatives' houses in case of death or joy, or when going out, should she place a cloth over her eyes or not?
A2: The widow must observe the waiting period for death, which is four months and ten days, if she is not pregnant, whether she is old or young; based on the saying of Allah the Exalted:[Al-Baqarah 2:234] She observes her waiting period in her husband's house where he died, and does not leave it for another place except for a need or dire necessity; such as visiting the hospital when ill, or buying her necessities from the market like bread and the like, if she has no one to do that for her; based on what Fari'ah bint Malik narrated, she said:
It was narrated by the five and authenticated by al-Tirmidhi , and al-Nasa'i and Ibn Majah did not mention the sending of Uthman . The scholars used this hadith as evidence that the widow observes her waiting period in the house where she received the news of her husband's death, and does not leave it for another place. The widow observing the waiting period for death must avoid beautiful clothes and wear other than that, avoid all types of perfume and the like, avoid adorning herself with gold and silver and the like, and avoid kohl; because the Messenger (peace and blessings be upon him) forbade the woman in waiting period from these things. She may speak to any of her mahrams she wishes and sit with them, and she may work in her house as she wishes and as she needs. As for the claim that she does not look at her husband when he dies or at his picture, this is not correct, as evidenced by the washing of Asma bint Umayyis, the wife of Abu Bakr , for him when he died, and by the report narrated from Aisha that she used to say:Al-Mustadrak lil-Hakim 28:108 .
It was narrated by Ahmad and Abu Dawud and Ibn Majah . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.

And those who are taken in death among you and leave wives behind - they, [the wives, shall] wait four months and ten [days]
My husband went out in search of a cure for him, so they caught him at the edge of the camp and killed him. The news of his death reached me while I was in a spacious house among my family's houses. I came to the Prophet (peace and blessings be upon him) and mentioned this to him, saying: The news of my husband's death reached me in a spacious house among my family's houses, and he left no maintenance or money for his heirs, and he had no residence. If I moved to my family and brothers, it would be more suitable for me in some of my affairs. He said: Move. When I went out to the mosque or to the chamber, he called me, or ordered me to be brought, and I was called, and he said: Remain in the house where the news of your husband's death reached you until the book reaches its term. She said: So I observed my waiting period there for four months and ten days. She said: And Uthman sent for me, so I informed him, and he acted upon it
It was narrated by the five and authenticated by al-Tirmidhi , and al-Nasa'i and Ibn Majah did not mention the sending of Uthman . If I had known in advance what I know now, I would not have allowed anyone other than women to wash the Messenger of Allah (peace and blessings be upon him)
لو استقبلت من أمري ما استدبرت ما غسل رسول الله -صلى الله عليه وسلم- إلا نساؤهIt was narrated by Ahmad and Abu Dawud and Ibn Majah . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
