The Shaykh : As long as you do not know the heirs of this man and you are unaware of any heir for him, then this belongs to the public treasury. If a man dies and has no heir, his wealth is paid to the public treasury.

The Shaykh : But on the condition that the public treasury is organized and its funds are disposed of according to the Shari'ah. If it is lost or mismanaged, then it is better to give it as charity. If it happens that one of his heirs comes forward later, then you give them the choice and say: I gave this money as charity. If you wish, it is yours and the reward is yours. If you wish, I will give you the money and the reward will be mine.
