Praise be to Allah alone, and may peace and blessings be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the Honorable Assistant Head of the Courts of al-Qasim in his letter No. (1457\2) dated 4\8\1416 AH, which was referred to the Committee by the General Secretariat of the Council of Senior Scholars with No. (3876) and date 8\8\1416 AH. The questioner asked a question, the text of which is as follows: We inform you that Saleh ibn Hamd ibn 'Abd al-Muhsin al-Tuwajiri approached me requesting the construction of a mosque and housing for the imam and the mu'adhdhin in Buraydah from the funds allocated for the benefit of his father's bequest, a copy of which is attached. Since he stated in his bequest: ("...I bequeath a third of my wealth to build a mosque or mosques... etc."), the matter was unclear to me: should we agree to build housing for the imam and the mu'adhdhin even if it is not explicitly mentioned, considering that this has become one of the necessities of mosques, or should we limit ourselves to the bequest? It is known that the site required for development is suitable and in need, and the land allocated for the mosque and the houses of the imam and the mu'adhdhin is sufficient. The owner of the land does not agree to develop the land as a mosque only, but insists that two houses for the imam and the mu'adhdhin be built on it.

After studying the question, the Committee responded that there is no objection to building housing for the imam and the mu'adhdhin from the bequest in which the bequeather stipulated building a mosque or mosques from his third; because housing for the imam and the mu'adhdhin is among the important facilities of the mosque. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
