Q3: I have an aunt who raised her sister's son until he grew up, married him, and married off her daughters. For the record, she is a widow with three daughters, all of whom are married. A misunderstanding arose between her and him, so she evicted him from her home. She now has a decent house, while he has only one room. She is 57 years old, and this son's mother is deceased; he has only brothers from his father, and he does not live with them but visits them occasionally. What do you advise her to do regarding her residence: should she bequeath it to him, or leave everything as it is, in which case he would have to vacate the room he is in for the sake of his heirs and so on? Please advise us on this. .
A3: If this woman wishes to bequeath a portion of this house to him, that is up to her, provided that the bequest does not exceed one-third of her estate.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
