Praise be to Allah alone, and may blessings and peace be upon the one after whom there is no prophet. The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the President General from the honorable judge of the Harub Court, in his letter No. (683) dated 22/11/1411 AH, which was referred to the Committee by the General Secretariat of the Council of Senior Scholars with No. (4948) dated 28/11/1411 AH. His Excellency asked a question, the text of which is as follows: A woman named (M. H. 'A.) came to us requesting that the marriage contract be performed for her with her fiancé, named (M. D. Y. 'A.). We performed the contract under our guardianship because she is a foundling whose father is unknown, and issued a certificate of non-entitlement with No. (81) dated 11/10/1410 AH. He then went to the Civil Affairs Department of ( Subay'a ) requesting that the woman be added to his family register, i.e., as his wife, and the procedures were carried out accordingly. Finally, a letter from the Director General of Social Affairs in the Southern Region, No. (290) dated 29/2/1411 AH, was attached to the documents, stating that in this case, regarding the status of this woman, she can be named (M. 'A. M. S.) as a preliminary step to adding her to her husband's register. Finally, the complete documents were submitted to us in letter No. (13466) dated 9/11/1411 AH, containing the request from Civil Affairs ( Subay'a ) to change the name of that woman so that her name becomes
(M. 'A. M. S.). Therefore, we would like you to clarify for us: Is it permissible to change her name from (M. H.) to (M. 'A. M. S.) as requested by Civil Affairs? We hope for your ruling on this matter. May Allah reward you with good and guide your steps.
After studying the question, the Committee responded that if the matter is as described, then the information in the register should be followed, if the aforementioned (M.) is attributed to her mother in it, and there is no need for modification. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
