All praise is due to Allah alone, and peace and blessings be upon the one after whom there is no prophet. And after that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from His Royal Highness Prince: Muhammad ibn Nawaf ibn Abdulaziz , the Ambassador of the Custodian of the Two Holy Mosques in London , and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (32002302) and date 17/7/1432 AH. His Highness asked a question, the text of which is as follows: The Muslim minorities in the West during the summer season face two problems regarding the times of prayer. The first is the disturbance of the Shari'ah sign for the entry of the time of the 'Isha' prayer, which means the red twilight disappears late. The second is the disappearance of the Shari'ah sign for the entry of the times of the 'Isha' and Fajr prayers, which means the red twilight continues until shortly before the appearance of daylight. And it was agreed upon by
a group of directors of Islamic centers in Britain and their imams that the Islamic Cultural Center in London should write to Your Eminence on behalf of everyone, seeking a ruling on this issue, after the attendees differed in determining the time of prayer when the sign is disturbed or disappears, splitting into two groups. And since the blessed month of Ramadan began in the summer time, in an area where the Shari'ah sign is absent, and there is hardship in this that is not hidden from Your Eminence, as it will also be a cause of disagreement and division of opinion if the matter is not settled by a fatwa from authorized bodies, therefore I have attached to Your Eminence the letter of the inquiry, hoping for an answer to it due to its great importance.

After the Committee studied the inquiry, it answered as follows: The Shari'ah has determined the times of the five prayers, as Allah the Exalted says:
Indeed, prayer has been decreed upon the believers a decree of specified times.إِنَّ الصَّلاَةَ كَانَتْ عَلَى الْمُؤْمِنِينَ كِتَابًا مَوْقُوتًا
[An-Nisa 4:103]
, and He says, Exalted is He:
Establish prayer at the decline of the sun [from its meridian] until the darkness of the night and [also] the Qur'an of dawn. Indeed, the recitation of dawn is ever witnessed.أَقِمِ الصَّلاَةَ لِدُلُوكِ الشَّمْسِ إِلَى غَسَقِ اللَّيْلِ وَقُرْآنَ الْفَجْرِ إِنَّ قُرْآنَ الْفَجْرِ كَانَ مَشْهُودًا
[Al-Isra 17:78]
. And it is established in the two Sahihs from the hadith of Buraydah - may Allah be pleased with him - from the Prophet - peace and blessings be upon him -:
Buraida told of a man asking God’s Messenger about the time of prayer, to which he replied, “Pray with us these two,” meaning two days. When the sun passed the meridian he gave command to Bilal who uttered the call to prayer, then he commanded him and he made the announcement declaring that the time to begin the noon prayer had come. He gave him command and he made the announcement declaring that the time to being the afternoon prayer had come when the sun was high, white and clear. Then he gave him command and he made the announcement declaring that the time to begin the sunset prayer had come when the sun had set. Then he gave him command and he made the announcement declaring that the time to begin the night prayer had come when the twilight had ended. Then he gave him command and he made the announcement declaring that the time to begin the dawn prayer had come when the dawn appeared. Next day he commanded him to delay the noon prayer till the extreme heat had passed and he did so, and he allowed it to be delayed till the extreme heat had passed. He observed the afternoon prayer when the sun was high, delaying it beyond the time he had previously observed it. He observed the sunset prayer before the twilight had ended; he observed the night prayer when a third of the night had passed; and he observed the dawn prayer when there was clear daylight. Then asking where the man was who had enquired about the time of prayer and receiving from him a reply that he was present, he said, “The time for your prayer is within the limits of what you have seen.”أن رجلا سأله عن وقت الصلاة ، فقال له : صل معنا هذين يعني : اليومين ، فلما زالت الشمس أمر بلالا فأذن ، ثم أمره فأقام الظهر ، ثم أمره فأقام العصر والشمس مرتفعة بيضاء نقية ، ثم أمره فأقام المغرب حين غابت الشمس ، ثم أمره فأقام العشاء حين غاب الشفق ، ثم أمره فأقام الفجر حين طلع الفجر ، فلما كان اليوم الثاني أمره فأبرد بالظهر وصلى العصر والشمس مرتفعة أخرها فوق الذي كان ، وصلى المغرب قبل أن يغيب الشفق ، وصلى العشاء بعد ما ذهب ثلث الليل وصلى الفجر فأسفر بها ، ثم قال : أين السائل عن وقت الصلاة ؟ فقال الرجل : أنا يا رسول الله ، قال : وقت صلاتكم بين ما رأيتم

. Likewise, the Shari'ah has determined the time of fasting, and Allah - Exalted and Majestic - said:
And eat and drink until the white thread of dawn becomes distinct to you from the black thread [of night]. Then complete the fast until the sunset.وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الْأَبْيَضُ مِنَ الْخَيْطِ الْأَسْوَدِ مِنَ الْفَجْرِ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْلِ
[Al-Baqarah 2:187]

If the night and day are distinguished by the appearance of Fajr and the setting of the sun, but the day is very long, it is obligatory for you to pray the prayers in their known Shari'ah times, and to abstain in the month of Ramadan from things that break the fast from the appearance of Fajr to the setting of the sun, whether the day is long or short, acting in accordance with the Shari'ah texts. And whoever is unable to complete the fast of a day due to the length of its day, or it is more likely in his opinion that
fasting will lead to his destruction or severe illness, or will lead to an increase in his illness or a delay in his recovery, he breaks his fast and makes up the days he did not fast in a time when he is able to fast; for the saying of Allah the Exalted:
Allah does not charge a soul except [with that within] its capacityلاَ يُكَلِّفُ اللَّهُ نَفْسًا إِلاَّ وُسْعَهَا
[Al-Baqarah 2:286]
, and His saying, Exalted is He:
So whoever sights [the new moon of] the month, let him fast it; and whoever is ill or on a journey - then an equal number of other daysفَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ وَمَنْ كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ
[Al-Baqarah 2:185]
. As for when the night and day are not distinguished, it is obligatory for you to pray the five prayers in every twenty-four hours, and to estimate their times and determine them, relying on the nearest country to you in which the times of the five obligatory prayers are distinguished, and this is by analogy to the estimation mentioned in the hadith of the Dajjal . It is established in the Sahih of Muslim that the Prophet - peace and blessings be upon him - told his companions about the Messiah the Dajjal , and they said:
How long will he remain on the earth ? He replied : Forty days, one like a year, one like a month, one like a week, and rest of his days like yours. We asked : Messenger of Allah, will one day’s prayer suffice us in this day which will be like a year ? He replied : No, you must make an estimateما لبثه في الأرض ؟ قال : أربعون يومًا ، يوم كسنة ، ويوم كشهر ، ويوم كجمعة ، وسائر أيامه كأيامكم ، فقيل : يا رسول الله : اليوم الذي كسنة يكفينا فيه صلاة يوم ؟ قال : لا ، اقدروا له
Sunan Abi Dawud 4321Sahih (Al-Albani)
. Likewise, it is obligatory for you to fast the month of Ramadan, and to estimate for your fasting, so that you determine the beginning of the month of Ramadan and its end, and the beginning of abstaining and breaking the fast, relying
on the nearest country to you in which the night and day are distinguished and their total is twenty-four hours; for what preceded in the hadith of the Prophet - peace and blessings be upon him - about the Dajjal .
