Q: I spent a great deal of money on my eldest son for his education and marriage. I was in a better financial situation then than I am now, to the point that I cannot spend on his brother what I spent on him. I do not want to wrong the younger one, nor do I want to contradict the hadith:
There is no bequest for an heirلا وصية لوارث
Should I consider what I spent on the elder as a debt on him to be added to what I left as inheritance, or should I consider what the younger one spends on his higher education and marriage as a debt on me to be taken from the inheritance? I ask for clarification of the ruling in the Shari'ah. May Allah reward you with good and do you well.

A: What you spent on your son for his sustenance and education is part of the obligatory maintenance you owe him. It is obligatory for you to provide for the younger one as long as he is in need and unable to earn a living, and it is not permissible for you to bequeath anything to him.
