Q: My brother passed away and leftthe bequestas follows: The bequest: (One-third of what I own is to be used to build a mosque in one of the poor Islamic countries). Information: When the bequest was written, one-third of the wealth was equal to one or two million, and today it has become more than ten million riyals. Questions: 1- Is it obligatory to allocate the amount for building one mosque or several mosques? 2- Is it permissible to build the mosque or part of the mosques inside the Kingdom, in order to prevent the endowment or endowments from falling into the hands
those who would direct it away from the purpose for which it was established? 3- In the case of building a mosque or several mosques and there being a cash surplus from the endowment allocation, is it permissible to establish an endowment for an orphan society or other charitable works such as memorizing the Qur'an, or must the surplus be allocated only for building mosques? A: The principle is to execute the bequest as the testator specified, by allocating a third of what he owns to build a mosque in one of the poor Islamic countries. If any part of the amount remains, it is to be spent on building a mosque or mosques in one of the poor Islamic countries. It is not permissible to spend any part of this bequest on anything other than the type specified by the testator, which is mosques, such as an endowment for an orphan society or other charitable works like memorizing the Qur'an or otherwise.
