Q: We live in a country that subsists on an annual harvest, which is the grape harvest. I would like to know: First: What is the zakat on crops? When we are harvesting the fruit, some people from the village and from outside come to us, called al-shahatin (the beggars), and they take their share. In fact, we carry some of the fruit to people in their homes. Is this counted as zakat or not? Second: When I gather the grape harvest and receive its price, I find that the debt has consumed the entire production. Do I owe zakat on the money?
A: Grapes are among the items that are measured and stored, so zakat is obligatory on them if what one owns of them reaches the nisab. The nisab for grains and fruits is five wasqs, and a wasq is sixty sa' (a dry measure of about 3 kg), which equals three hundred sa' by the sa' of the Prophet (peace and blessings be upon him). The grapes are estimated when their ripeness becomes apparent, just as the date palms are estimated. Their zakat is paid in raisins, just as the zakat on date palms is paid in dates. One pays out one-tenth if they are watered without expense, one-half of one-tenth if they are watered with expense, and three-quarters of one-tenth if they are watered by both methods and are equal in benefit. If they differ, the consideration is given to the one with the greater benefit. What you give of the grape fruit to those who ask for charity, or what you give to some people in their homes, if they are poor and you give it to them with the intention of zakat and you know its amount, then it suffices for the zakat obligatory upon you and is counted as zakat.
And if the grape fruit given to them is not for those entitled to zakat, or if you did not give it to them with the intention of zakat, or if you do not know its amount, then it does not suffice for the zakat obligatory upon you; rather, it is a charity among the charities for which you will be rewarded, if Allah wills. The debt that is upon you and consumes the grape production does not prevent the zakat obligatory upon you, due to the generality of the saying of Allah the Exalted:[Al-An'am 6:141], and His saying the Exalted: [Al-Baqarah 2:267], and His saying the Exalted: [An-Nur 24:56]. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.

وَآتُوا حَقَّهُ يَوْمَ حَصَادِهِO you who have believed, spend from the good things which you have earned and from that which We have produced for you from the earth
يَا أَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الأَرْضِAnd establish prayer and give zakah and obey the Messenger - that you may receive mercy.
وَأَقِيمُوا الصَّلاَةَ وَآتُوا الزَّكَاةَ وَأَطِيعُوا الرَّسُولَ لَعَلَّكُمْ تُرْحَمُونَ
