Q: The father has date palms exceeding sixty. How is their zakah to be paid? Previously, the father would designate a certain palm as a gift to so-and-so, another to so-and-so, and another to so-and-so. Some of them are relatives with whom we have family ties, some are neighbors, and others are people of other categories. Does this method suffice, such that the palm given to so-and-so and so-and-so is considered zakah and is sufficient, or is something else required? I ask for a detailed written response, as there are many such cases among the owners of the village. ?
A: The gift mentioned does not suffice. It is obligatory for those upon whom zakah is due to pay zakah from all the dates if they reach the nisab. The obligatory amount is half of one-tenth
for what is irrigated by wells and the like, and one-tenth for what is irrigated by rainwater, rivers, springs, and the like. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
