Q: The inquirer asked a question regarding the agreement concerning the assistance of married members of his tribe, and requested a ruling on it. The inquiry stated: “My refusal to accept this agreement has led the tribe to threaten me and my children with boycott, even in times of hardship, such as blood money, compensation for injury, and the like, because of this agreement. Since excluding me and my children will cause us severe harm, and we have committed no sin other than seeking the legitimacy of this agreement, I ask Your Eminence to issue a ruling on the aforementioned agreement, signed on 22/3/1426 AH, so that I may convince my community of this and ward off harm from myself and my children. The text of the purpose of this agreement is as follows: (On the night of 22/3/1426 AH, the delegates of the group (.....) met in the Naib’s council to determine what the entire group had agreed upon regarding the assistance of married members, in order to realize the principle of mutual support and cooperation among the group’s members and to realize the principle of equality among them. The previously discussed matters, which the group approved, were summarized in the following points: First: The assistance for a first-time marriage shall be an amount of twenty thousand (20,000) riyals. Second: The assistance for a second marriage shall be an amount of ten thousand (10,000) riyals.
Third: It was decided that the names of the male members of the group shall be updated on 30/2 of each year, and it was decided that the amounts, whether twenty thousand or ten thousand, shall be distributed among the number of group members at that time. Fourth: Anyone who refuses to participate with the group in what they have decided shall not be eligible for what was decided in the first and second paragraphs, and the group shall not attend any marriage at his place. Fifth: The members of the group are obligated to attend the married person’s wedding occasion and not to hold other occasions on the same day of the wedding that conflict with it. A: After the Permanent Committee for Scholarly Research and Ifta studied the aforementioned inquiry and agreement, it responded as follows: Cooperation among the members of a tribe by assisting those who are financially unable to afford marriage is a desirable matter, and it is part of cooperation in righteousness and piety. However, it is not permissible for this to be compulsory; rather, the assistance should be given willingly. This is based on the saying of the Prophet (peace and blessings be upon him):
Verily your blood, your property are as sacred and inviolableإن دماءكم وأموالكم حرام عليكم
Sahih Muslim 1218a
It is agreed upon by al-Bukhari and Muslim. Also, because this will be a cause of disputes, hatred, and enmity. It is not permissible for the tribe to boycott any of its members if he does not contribute to the assistance.
