Q4: The fatwas state that it is permissible to take the in-kind zakah, in most cases, from either of the two types of sheep (sheep and goats), and likewise to pay the in-kind zakah for each type separately. However, in the case where the two types are equal in number, if the person liable for zakah brings goats instead of sheep, even though the market price of sheep is generally higher than that of goats, should the value be considered in this case? That is, by taking the value of the average of the number of nisabs, and accepting the in-kind payment if its value at the time of payment is equal to or greater than the cash value, while rejecting anything less? Or is the principle to pay it in kind from one of the two types? Or should the preference of the person liable for zakah be considered?
A4: Goats are combined with sheep to complete the nisab, and the obligatory amount is taken from either one according to the value of the two types of wealth. Al-Muqaddam stated in (Al-Mughni) and other works: “We are not aware of any disagreement among scholars regarding combining different types of the same species with one another, and paying the zakah in either type according to the value of the two types of wealth. If there are twenty sheep and twenty goats, one takes from either one an amount whose value is half a sheep
and half a goat.”
