Praise be to Allah alone, and blessings and peace be upon the one after whom there is no prophet. Having reviewed the matter sent to His Eminence the Grand Mufti from His Eminence Abd al-Rahman ibn Muhammad al-Raqib , President of the Courts of the Eastern Province , number (9973/30) dated 12/4/1430 AH, and its attachments regarding the bodies in the refrigerator of one of the hospitals in the province of al-Ahsa , referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (550) and date 18/4/1430 AH, the Permanent Committee for Scholarly Research and Ifta responded as follows. His Eminence’s letter stated: We are forwarding to Your Eminence what we received from His Excellency the Deputy Governor of the Eastern Province , number (13/19817) dated 9/4/1430 AH, based on the letter from His Excellency the Deputy Governor of al-Ahsa , number (5/7114) dated 25/3/1430 AH, regarding the disposal of the bodies in the refrigerator, which number (34) and pertain to the al-Huwayyah incident that occurred on
8/11/1429 AH, and their request for a religious ruling regarding burying them and praying over them, since some of the deceased are non-Muslims and it is difficult to distinguish their parts and bodies due to their mixing with one another.

After studying the inquiry, the Committee responded as follows: If a group of Muslims and non-Muslims die in an incident and their bodies are mixed together, one must exert effort to distinguish the Muslims from the others by identifying what remains of their bodies. If they cannot be distinguished, all are washed, shrouded, prayed over, and buried in the cemetery with the intention that the prayer is for the Muslims among them, whether the number of Muslims is fewer or more. It is established that he (peace and blessings be upon him) greeted a gathering containing a mix of Muslims and polytheists with the intention of greeting the believers among them specifically.
