Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet. And after that:
The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the President General from His Excellency the General Manager of the Maternity and Children’s Hospital in Jeddah , which was referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (2254) and date 11/5/1412 AH. His Excellency asked a question, the text of which is as follows: We wish to inquire from Your Eminence about the following: A child is born to a mother and father who are not Muslims. In some cases, Allah does not grant this child life, so he dies in his mother’s womb and is born dead, or this child dies within hours of his birth. Is such a newborn to be treated as a Christian in religion, or as a Muslim by fitrah (innate natural disposition)? And where is he to be buried? May Allah reward you with good .
After studying the inquiry, the Committee responded that if the matter is as described, the aforementioned newborn is to be treated as a non-Muslim, and he is not to be buried in Muslim cemeteries. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
