Q: What is the ruling in the Shari'ah regarding a person who has lost both hands and is unable to perform wudu' , is the obligatory prayer dropped from him or not?
A : Prayer is obligatory upon a person and does not fall off him in any case as long as his intellect is present, for the basis of legal responsibility is reaching puberty and having intellect. The command to pray does not fall off due to the loss of a limb or the occurrence of an illness or the like of such circumstances; due to the generality of the evidence from the Book and the Sunnah and the consensus of the scholars on this. However, one who
is afflicted with something in his body and is unable to perform all the obligations and pillars of prayer, he prays according to his ability. And one who has both hands cut off, if he is able to perform his own wudu' or through the assistance of someone who helps him to do so, he does so. Otherwise, wudu' falls off him and he prays in the state that is within his capacity; for the saying of Allah the Exalted:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[At-Taghabun 64:16]
, and His saying (Exalted and Majestic is He):
Allah does not charge a soul except [with that within] its capacityلاَ يُكَلِّفُ اللَّهُ نَفْسًا إِلا وُسْعَهَا
[Al-Baqarah 2:286]
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
