Q: I ask your Eminence to clarify this matter: In Fatwa No. ( 8382 ), the sixth question reads as follows: Is it permissible to pray over a funeral in an area of the cemetery free of graves inside the cemetery or not? The answer was: It is permissible, and the Prophet (peace and blessings be upon him) prayed the funeral prayer in the cemetery over the woman who used to clean the mosque, where she died and they buried her without informing him. When he learned of it, he said, "Show me her grave." When they showed him, he went to her grave and prayed over her. In Fatwa No. ( 9269 ) dated 23/12/1405 AH, the second question states: On the day one of the people died, we went with the funeral procession to the cemetery, and after praying over the funeral, they lowered the deceased into the grave and called the adhan at the head of the deceased. I ask you to inform us of the ruling on that, and what should be done? The answer was: It is not permissible to call the adhan or the iqamah at the grave; because it was not reported

A : There is no contradiction or conflict between what was stated in the first fatwa and the second fatwa issued by the Permanent Committee, because the matter asked about in the first fatwa differs from the matter asked about in the second fatwa. There is no doubt that praying over the deceased in the cemetery is permissible due to the action of the Prophet (peace and blessings be upon him) as mentioned, but it is not permissible to call the adhan or the iqamah at the head of the deceased after praying over him and placing him in the grave. The adhan and iqamah at the grave are a religious innovation with no basis in the Shari'ah, as the Prophet (peace and blessings be upon him) did not do it, nor did any of his Companions (may Allah be pleased with them), as mentioned in the fatwa. Thus, the difficulty is resolved, and the funeral prayer has no adhan or iqamah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
