Q: In these days, gatherings in rest houses have become numerous. These rest houses, due to their large numbers and proximity to nearby mosques, are situated so that the people of the rest houses do not miss the congregational prayer
and its virtue. However, some of the brothers say: Since we are a congregation, it is permissible for us to pray in our location, knowing that the mosque is nearby and the call to prayer can be heard. This is on the grounds that the emphasis is on the congregation, not on the mosques, and that the reward is obtained by whoever prays with the congregation, even if he is not in the mosque, and the mosque is near him. What is the ruling of the Shari'ah regarding the one who fasts in Ramadan and leaves the congregational prayer in the mosque on the grounds that he prays in congregation in the rest house ? Is the one who leaves the congregational prayer in the mosque considered an open sinner and a transgressor? What is the advice that Your Eminence directs to these people? We wish for this to be a fatwa distributed to the visitors of the rest houses. And is it permissible for a traveler to leave the congregational prayer if he is in a place other than his hometown?
A: It is obligatory for Muslims to pray the five daily prayers in congregation in the mosque; because the mosques were not built except for that, and because the Prophet (peace and blessings be upon him) said:Sahih Ibn Hibban 10:352 , and because he (peace and blessings be upon him) intended to burn the houses of those who lagged behind in the prayer in the mosque with fire, and he did not ask whether they were praying in congregation in their houses or not, and because he (peace and blessings be upon him) did not grant a dispensation to the blind man who did not find a guide to take him to the mosque to pray in his house, but rather he ordered him to respond to the mu'adhdhin and pray in the mosque, and performing the prayer in congregation in the mosque is the practice of Muslims, both in the past and the present.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

Whoever hears the call and does not respond, he has no prayer, except one who has an excuse.
من سمع النداء فلم يجب فلا صلاة له إلا من عذرAnd success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
