Q: I acted on the fatwa attributed to the Shaykh: Muhammad ibn Uthaymeen (may Allah have mercy on him), that it is permissible to abort the fetus before four months, so my wife aborted her fetus using a treatment I bought for her for the purpose of abortion. It turned out after the abortion that the fetus was more than four months old. Do I have to pay an expiation, or does my wife?
A: Your wife has to pay the expiation for killing; because she directly caused the abortion. The expiation for killing is freeing a believing slave, and if she cannot find one, she has to fast two consecutive months, along with repenting to Allah the Exalted; because what happened from her is a forbidden matter for which she is sinful. As for you, you have committed a great sin and a major crime by participating in bringing the medicine that causes abortion, so you have to repent from that and seek forgiveness, and you do not have to pay an expiation in this case.
