The questioner : To abort her child while it was less than four months old, and she did so. What is the ruling on this?

The Shaykh : If the soul has not been breathed into it, we look at the situation. If there is fear of harm to the woman, there is no harm in her aborting it. If there is no fear of harm to her, it is not permissible for her to abort it, even if her husband orders her to, because she has a right to this child. However, some people, may Allah protect us from them, have no concern other than satisfying their desire, and perhaps he intends to divorce her and fears that if she gives birth, there will be a problem regarding the divorce. So we say: The woman is not obligated, if her husband orders her to abort her pregnancy, to abort it under any circumstances. As for if the soul has been breathed into it and it has reached four months, it is not permissible to remove it ever, not by the order of the husband, not by the order of the doctor, nor by anything else.
