Q: Praise be to Allah alone, and blessings and peace be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the esteemed Director of the Dawah and Guidance Center in Jeddah, and referred to the Committee by the General Secretariat of the Council of Senior Scholars, with number (516) and date 28/1/1416 AH. The questioner asked a question, the text of which is as follows: The imam of one of the mosques in Jeddah came to us and stated that he is suffering from a disease in the large intestine that causes him severe constipation, and he feels the exit
from his belly. Therefore, he performs wudu for every prayer after its time has entered, but sometimes he leads people in prayer and wind comes out of him during the prayer, and he is certain of this by the sound or the wind. He asks: 1 - Does his ignorance of the ruling on wind coming out of him affect the ruling, given that he thought that wind coming out of him without his will does not affect his purity? 2 - What is the ruling on praying behind him while knowing that wind comes out of him? 3 - Is he obligated to inform those who prayed behind him of the prayers he performed while not in a state of purity, and what is the ruling if he does not know the number of prayers he performed while not in a state of purity, and how does he inform the people of them? 4 - Do you advise him to continue as imam? Knowing that his illness is not incontinence of wind, but rather a condition that occurs to him occasionally, making it difficult for him to hold back what is in him. I hope you will kindly review and answer him with what you see fit.
A : After the Committee studied the inquiry, it answered as follows: If the situation is as mentioned in the question, that the passing of wind from the person mentioned is not continuous, but rather comes out without his control at times, then if it comes out of him during prayer or outside of it, he must repeat the wudu; because his state of ritual impurity is not permanent. It is better that he not be an imam; because he disturbs the people if the mentioned condition occurs to him. As for what has passed
due to his ignorance of the ruling, we hope that Allah will forgive him. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad and his family and companions.
