Q: Everyone is aware of the extent of the harm inflicted on citizens by
workers who violate residency regulations, due to their resorting to unlawful means of earning money, such as theft and committing crimes, and so on. This is happening while our wise government (may Allah preserve it) is tightening the noose on them and has established systems that prohibit dealing with them. As Your Eminence is aware, this workforce spreads after performing 'Umrah and the obligatory Hajj. There is a category of citizens who smuggle them from one area to another merely to earn money, ignoring their harm to citizens and violating the systems established by the state and those in authority. What is the ruling on smuggling those who violate residency and work regulations from one area to another? And what is the ruling on harboring them and employing them by citizens?
After studying the inquiry, the Committee answered that the competent authorities in the state have established systems and instructions regulating the presence of expatriate workers and their movement from one place to another, and who is permitted to work for them. Adhering to those systems and instructions is obligatory, and it is not permissible to violate them or circumvent them in any way; for Allah the Mighty and Majestic says:[An-Nisa 4:59]. Therefore, what the one in authority issues to realize the public interest must be adhered to, and whoever violates it commits a sin.
Based on this, it is not permissible to transport or employ expatriate workers except in accordance with what the systems and instructions require in this regard. The one who conceals such workers commits a sin, as does the one who employs them and the one who transports them; because each of these people is cooperating in sin and aggression, and Allah the Mighty and Majestic says:[Al-Ma'idah 5:2].

O you who have believed, obey Allah and obey the Messenger and those in authority among you
يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الأَمْرِ مِنْكُمْBased on this, it is not permissible to transport or employ expatriate workers except in accordance with what the systems and instructions require in this regard.
