Q 7: A man residing in a country where there is no cemetery exclusively for Muslims died there, and he had a house, so he was buried in front of his house or behind it; because the Muslims disliked burying him in the cemetery of the polytheists. What is the ruling on that, and is it permissible to pray in a mosque that contains a grave?
A 7: First: The principle is that a Muslim should be buried with the general Muslim population in public cemeteries, but if he is buried in his house or in land that belongs to him specifically due to the absence of a public cemetery for Muslims, then the burial is permissible and there is no blame on him. Second: It is not permissible to pray in a mosque that contains a grave under any circumstances, whether the grave is in front of the worshippers, behind them, or to their side; because prayer in that case is a means to shirk (associating partners with Allah), and the Prophet (peace and blessings be upon him) prohibited that and cursed whoever did it. In the two Sahihs, it is narrated from Aisha (may Allah be pleased with her) that she said: The Messenger of Allah (peace and blessings be upon him) said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد

And in the Sahih of Muslim , it is narrated from Jundub ibn Abdullah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said:
Beware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم وصالحيهم مساجد، ألا فلا تتخذوا القبور مساجد فإني أنهاكم عن ذلك

. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
