And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from His Royal Highness the Prince of the Makkah al-Mukarramah Region, acting in his capacity, with reference number (Am / 2656) and date 19 / 3 / 1416 AH, which was referred to the Committee by the General Secretariat of the Council of Senior Scholars with reference number (1417) and date 24 / 3 / 1416 AH. The text of His Highness’s telegram reads: We received a telegram from the Jeddah branch of the Ministry of Foreign Affairs, number (91 / 83 / 142 / 241 / 1), dated 21 / 1 / 1416 AH, based on what it received from the British Consulate in Jeddah , number (204), dated 19 / 1 / 1416 AH, stating that Mr. Mustafa Mahmut , a British
national, passed away in Makkah al-Mukarramah while performing the obligatory Hajj for the year 1415 AH, and was buried in Makkah al-Mukarramah . His family informed the consulate that the deceased had wished to be buried next to his family members in Northern Cyprus , and the consulate requested that the competent authorities be informed to issue instructions for the removal of the body and permission to transfer it to Northern Cyprus for reburial. The Ministry of Foreign Affairs requested a response. His Highness the Prince of the Region, acting in his capacity, issued a directive stating: Inquire about this from the concerned authorities. We hope you will review this and inform us about how the deceased was buried without obtaining permission from his country’s consulate, and who authorized his burial without the consent of his relatives or the consulate. His Eminence the Grand Mufti of the Kingdom and the Head of the Department of Scientific Research and Ifta have provided us with a copy of this telegram to inform us about the possibility of removing the body and sending it to his country for burial there, or not. With our regards.
After the Permanent Committee for Scholarly Research and Ifta studied the matter, it held that it is not permissible to exhume the deceased, as there is no valid legal basis for exhuming and transferring him. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
