Fatwa No. ( 20237 )
Praise be to Allah alone, and blessings and peace be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the inquirer, the Director of the Dawah and Guidance Center in Dammam , which was referred to the Committee by the General Secretariat
of the Council of Senior Scholars with number (121) and date 3 / 1 / 1419 AH. His Eminence asked a question, the text of which is as follows: I am forwarding to Your Eminence a fax from His Excellency the Director of the Police Department of al-Na'iriyah Province, number (21 / 34 / 7697) and date 25 / 12 / 1418 AH, regarding his inquiry about the Shari'ah ruling, the text of which is as follows: A human skeleton was found on the date 20 / 12 / 1417 AH, and from the course of the investigation, it is possible that the person was Indian or Bangladeshi. Approval was issued by the Regional Emirate of the Eastern Region to bury the skeleton. Since we do not know anything about his religion, and whether he should be buried in the Muslims' cemeteries or not, we contacted His Eminence the Judge of our court, and he directed that this depends on a Shari'ah fatwa. The text of the question ends here. And since His Excellency requested to be provided with a written fatwa, his request was forwarded to Your Eminence. I hope Your Eminence will look into this and issue a fatwa to him quickly, as you see fit. May Allah grant you health and well-being, multiply your reward and recompense, and benefit us and the Muslims in general with your knowledge.
After the Committee studied the inquiry, it answered that if the situation is as described, then this deceased is buried alone in a wilderness in a place far from desecration. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
