Q: The cemetery in which our dead are buried has become cramped on all sides, and it is full, except that there are places where burial took place more than fifty years ago. We ask your eminence to issue a ruling on the permissibility of burying in the section where burial took place a long time ago. May Allah preserve you and care for you.
A : It is not permissible to bury in graves in which people have previously been buried, because they have become the right of those who were buried there first, so it is not permissible to encroach upon that right. If the cemetery becomes cramped, one must look for another place to bury in.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
