Q: Is it obligatory for us, the children of the deceased, to repay the entire loan in a single payment, given that the aforementioned loan was agreed to be repaid over a period of twenty-five years, and given that we are making payments to the real estate bank as they come due? Does our deceased father incur any sin due to our delay and not repaying the bank in full? We are simple employees and do not have the means to pay the bank’s full entitlement. Also, if our father (may Allah have mercy on him) had a debt to individuals we do not know, and they have not come forward to claim it, while we are asking everyone who knew our father: “Does our father have a debt to you?” and some answer in the negative, but we fear there may be people to whom he owed a debt whom we do not know, due to his acquaintance with some people. Please inform us, may Allah reward you, and may Allah reward us with the best reward.
A: You have the choice between repaying your father’s debt to the real estate bank in a single payment, or repaying it in the installments followed by the bank. Your father will not incur any sin in that, if Allah wills, because the term is his right,
and the debt is secured by a pledge. If you do not know anyone to whom he owed debts other than the bank, and you have announced this and no one has come forward, then there is no blame on him or on you. You have done well, may Allah reward you with good for your diligence in seeking to clear your father’s liability. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
