The questioner : Suppose this lady did not know the ruling and was living with this man who has been ruled to be an apostate. He is a man of harsh temperament, quick to anger, and prone to many problems to the extent that he loses his senses when angry, cursing Allah and declaring disbelief in everything, may Allah protect us from that, and swearing oaths of divorce over her without realizing it. Do these oaths of divorce take effect, considering that if we were to count them, we would find they exceed ten times over separate periods?

The Shaykh : When we say that he is a disbeliever, meaning the disbeliever who abandons prayer, it is obligatory for the woman to leave him and not remain with him.

The questioner : Yes.

The Shaykh : Because the marriage has been annulled. If it has been annulled, how is it permissible for her to remain with a husband from whom her marriage has been annulled? There is no need to suppose that he divorces her and does this and that, as long as we have ruled that he is a disbeliever. The matter is clear in this, and this is a place where there is no ambiguity or confusion. If it becomes clear to a person from the Book of Allah, the Sunnah of His Messenger (peace and blessings be upon him), and the saying of the Companions that the one who abandons prayer is a disbeliever whose disbelief takes him out of the religion, then there is no reason to hesitate in annulling his marriage from his wife. Yes.
