Q3: A person has become accustomed to saying the phrase: (It is haram upon me) or (Haram by Allah). What is the ruling, given that you know he says it with good intention; that is, he does not intend to make his wife haram to himself? And does this fall under the category of idle oaths?
A3: If a man intends his wife by his saying (It is haram upon me), then this is zihar, and the kaffarah of zihar is obligatory upon him, which is freeing a slave. If he does not find one, then he must fast two consecutive months before touching his wife in both cases. If he is unable to do so, then he must feed sixty poor people, giving each poor person half a sa' of food, which is one and a half kilograms. If he did not intend his wife by this phrase, then the kaffarah of an oath is upon him, and he has the choice between freeing a believing slave, or feeding ten poor people, or clothing them. If he does not find the means to do so, he must fast three days. If this phrase slips off his tongue and he did not intend it, then nothing is upon him, because it is idle talk.
