Q: RightDoes the person sitting in the majlis have the right to return to his seat from another person, or is it that if he stands up from the gathering, he has no priority to return to his seat? I hope you will issue a ruling on this matter in writing.
A : The one sitting has more right to his seat than another person if he stands up for his need and then returns to it; for what was narrated by Muslim and Abu Dawud from Abu Hurayrah (may Allah be pleased with him): that the Messenger of Allah (peace and blessings be upon him) said:
When one of you gets up from his place and then returns to it, he is more entitled to.إذا قام أحدكم من مجلسه ثم رجع إليه فهو أحق به
Al-Adab Al-Mufrad 1138
And in (Sunan al-Tirmidhi ) from Wahb ibn Hudhayfah al-Ghifari (may Allah be pleased with him
(may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) said:
A man has more right to his seat. If he leaves for some need of his, then he returns, then he has more right to his seat.الرجل أحق بمجلسه، فإذا خرج لحاجة ثم عاد فهو أحق بمجلسه
