Fatwa No. ( 5262 )
Q: I have an elderly mother, and I am her son. I was afflicted with an illness that struck me about two years ago, and I asked Allah, the Exalted, that if He cured me
that she would fast every Thursday and Monday of the week. Today, when I see her weakness and the emaciation of her body, where skin is all that covers her bones due to her extreme weakness, and I have argued with her many times to leave off this fasting, and I am willing to feed a poor person every Thursday and Monday on her behalf for her fasting, and I will fast on her behalf if that is permissible, I ask you to inform me of what is permissible among these solutions.
A: If the situation is as described, and her fasting on Mondays and Thursdays of every week to fulfill her vow is something that burdens her and makes it extremely difficult for her, then it suffices for her to expiate her vow with the expiation of an oath; because of His saying, the Exalted:[Al-Baqarah 2:286] , and His saying: [Al-Hajj 22:78] , and His saying: [Al-Baqarah 2:185] , and the saying of the Prophet (peace and blessings be upon him): narrated by Abu Dawud and Ibn Majah .
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

Allah does not charge a soul except [with that within] its capacity
لاَ يُكَلِّفُ اللَّهُ نَفْسًا إِلا وُسْعَهَاand has not placed upon you in the religion any difficulty
وَمَا جَعَلَ عَلَيْكُمْ فِي الدِّينِ مِنْ حَرَجٍAllah intends for you ease and does not intend for you hardship
يُرِيدُ اللَّهُ بِكُمُ الْيُسْرَ وَلاَ يُرِيدُ بِكُمُ الْعُسْرَThe expiation of a vow is the expiation of an oath. Whoever makes a vow without specifying it, its expiation is the expiation of an oath. And whoever makes a vow that he cannot fulfill, its expiation is the expiation of an oath.
كفارة النذر كفارة يمين، من نذر نذرًا ولم يسمه فكفارته كفارة يمين، ومن نذر نذرًا لم يطقه فكفارته كفارة يمينAnd success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
