Q: A married woman said: If Allah heals my child, then I have vowed to Allah that I will fast every Monday and Thursday of every week for the rest of my life. Her husband did not give her permission to do this. Consequently, he was harmed by her fasting, as he fears fitnah (trial, discord or temptation) for himself. Does she have to expiate her vow because of her husband's right, given that he was harmed, or not? If expiation is required, does she expiate for the vow in general, meaning for all the vows at once, or for each day she breaks her fast? What type of expiation is it, the expiation for fasting or something else? If she is allowed to expiate and is able to fast on some days, is she obligated to fast on those days, as if her husband had permitted her to fast on that specific day or if he were traveling? If she is obligated to fulfill the vow, does her husband sin if he forces her to break her fast or has intercourse with her while she is fasting?
A: If the matter is as stated, that the woman mentioned vowed the aforementioned vow of expiation by fasting on Thursdays and Mondays of every week if Allah healed her child, and Allah did heal him, and that she is married and her husband did not give her permission, and that this harms her husband's legal rights, then it is established in the Shari'ah that it is obligatory
to fulfill the vow, such as the aforementioned vow of expiation. However, since the husband's right takes precedence over the obligation of the aforementioned vow, and the husband is deprived of some of his marital rights, she must dissolve her aforementioned vow by paying the expiation for an oath. This is: freeing a believing slave, or feeding ten poor people, giving each of them half a sa' (a dry measure of about 3 kg) of wheat, rice, or other staple food of the country, which amounts to one and a half kilograms by weight, or clothing them. If she cannot do so, she must fast for three days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
