Q: Is it the case that swearing by other than Allah (Blessed and Exalted is He) in terms of meanings does not constitute shirk (associating partners with Allah), while swearing by other than Allah (Blessed and Exalted is He) in terms of entities is what constitutes shirk?
A
Swearing by other than Allah is minor shirk; as narrated by the Imam Ahmad , Abu Dawud , and al-Tirmidhi , who graded it as good: that the Prophet (peace and blessings be upon him) said:
He who swears by anyone or anything other than Allah, has indeed committed an act of Kufr or Shirkمن حلف بغير الله فقد كفر أو أشرك
Riyad as-Salihin 1711
And if one intends in his oath to exalt the thing by which he swears as he exalts Allah, then it is major shirk. It is not permissible whether one swears by the entities themselves or by their meanings; all of that is not permissible. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
