Fatwa number ( 18996 )
Q: We are a tribe in a village south of al-Ta'if , with a population of more than two hundred people. We perform a charity in the month of Ramadan consisting of slaughtering a calf, which is divided among the poor, and the surplus is divided equally among the tribe. We pay for it equally among the males of the tribe. When we asked the elders, they told us that this dates back to the time of the ancestors, fifty years ago, when the Shaykh of the tribe at that time went to some fortune-tellers. They told him that he should slaughter a calf in the month of Ramadan for the sake of Allah the Exalted, because the people of the village had killed a soul without cause, and they had perished until only a few remained, not exceeding nine people. This charity is an expiation for that, and the situation has remained as it is until this date. We wish to be guided, even though we do not slaughter except for the sake of Allah the Exalted, and we do not intend anything else in it.
A : It is not permissible for you to continue with this practice; rather, it is obligatory for you to abandon it and repent to Allah from it; because it is from the practices of the pre-Islamic age of ignorance and from the advice of the fortune-teller. It is not permissible to go to a fortune-teller or to believe what he says; due to the saying of the Prophet (peace and blessings be upon him):Sunan Ibn Majah 639Hasan (Darussalam) (peace and blessings be upon him). The obligation regarding the killing of a soul, if it was intentional aggression, is retaliation against the
killer, unless his awliya (close friends of Allah) forgive him by accepting blood money or for free. If the killing was accidental, the obligation is blood money for his awliya (close friends of Allah) from the 'aqilah (clan) of the killer, unless the awliya (close friends of Allah) of the victim forgive him. The expiation is upon the killer, and it is freeing a believing slave. If he does not find one, he fasts two consecutive months. This is the Shari'ah ruling regarding what is required for killing without right. The reference for this is the Shari'ah court. As for what you mentioned, it is from the rulings of the pre-Islamic age of ignorance, so it must be abandoned. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
