Fatwa number ( 19603 )
Q: What is the ruling on a disbeliever who was in a hospital bed, and we heard him say: "There is no god but Allah" and "Muhammad is the Messenger of Allah" (peace and blessings be upon him), until death overtook him. Does
he count as a Muslim or not?
A: One who utters the two testimonies before the soul reaches the throat, and was not saying them while in good health while practicing types of major shirk (associating partners with Allah), then dies, is considered a Muslim by that, and is treated as a Muslim in terms of washing, praying over him, burying him, and supplicating for his forgiveness and mercy. This is indicated by the saying of the Prophet (peace and blessings be upon him):Jami` at-Tirmidhi 3537Hasan (Darussalam) narrated by Ahmad and al-Tirmidhi and others. Also, his story (peace and blessings be upon him) with his uncle Abu Talib , and his offering of the testimony to him while he was on his deathbed, but he refused to utter it, as in the authentic collections. Also in the authentic collections: .
As for one who used to utter the two testimonies while in good health, but worshipped other than Allah, such as asking the dead for help and seeking aid from them, and making vows and slaughtering for them, then this person is not considered a Muslim merely by uttering the two testimonies at the time of death, unless he explicitly repents from his previous shirk (associating partners with Allah). And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
