The questioner: And is it permissible to kill him if the fighting becomes intense and he pronounces the two testimonies of faith?The Shaykh: If he pronounces the two testimonies of faith, it is not permissible to kill him whether the fighting becomes intense or not; because the Prophet (peace and blessings be upon him) rebuked Usamah ibn Zayd for killing a polytheist after he said: “There is no god but Allah,”And he kept repeating to Usamah: (Did you kill him after he said, “There is no god but Allah”?Until he said: He only said it as a means of seeking protection) So the Prophet (peace and blessings be upon him) rebuked him and said, Usamah: [I wished I had not become a Muslim] But if he says: “I bear witness that there is no god but Allah and that Muhammad is the Messenger of Allah” and remains in the ranks of the disbelievers, kill him. But if he says this and leaves, that indicates his sincerity. If he remains, then if he is a Muslim, he has aided the disbelievers against the Muslims, and it is permissible to kill him, and his intention is with Allah. And if he is a polytheist and said it with his tongue, he has deserved to be killed.
