Q3: What is the ruling on eating from a slaughtered animal if the slaughterer forgot to mention the name of Allah over it , with mention of the evidence?
A3: It is permissible to eat from it according to the well-known view of the school of Ahmad , and this is
reported from Ibn 'Abbas (may Allah be pleased with them both), and this is the view of Malik , al-Thawri , Abu Hanifah , 'Ata , Tawus , Sa'id ibn al-Musayyib , al-Hasan , 'Abd al-Rahman ibn Abi Layla , Ja'far ibn Muhammad , and Rabi'ah ; because it is the statement of Ibn 'Abbas , and no one is known to have contradicted him among the Companions (may Allah be pleased with them). As for His saying, the Exalted:
And do not eat of that upon which the name of Allah has not been mentionedوَلاَ تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللَّهِ عَلَيْهِ
[Al-An'am 6:121]
, it is understood to apply to what one intentionally left off mentioning the name of Allah over; by the evidence of His saying in the verse:
and indeed it is open sinfulnessوَإِنَّهُ لَفِسْقٌ
, and eating from what one forgot to mention the name of Allah over is not open sinfulness. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
