The questioner : The honorable Shaykh says: If a person slaughtered his udhiyah and forgot to mention the name of Allah, and there was another person who said, "I said the takbir for you," is his udhiyah valid or not?

The Shaykh : His udhiyah is not valid, and eating it is forbidden, due to the saying of Allah, Blessed and Exalted is He:
And do not eat of that upon which the name of Allah has not been mentioned, for indeed, it is grave disobedience. ولا تأكلوا مما لم يذكر اسم الله عليه وإنه لفسق
[Al-An'am 6:121]
. And due to the saying of the Prophet (peace and blessings be upon him and his family):
(Use) whatever causes the blood to flow, mention the Name of Allah and eat ما أنهر الدم وذكر اسم الله عليه فكل

So the Prophet (peace and blessings be upon him and his family) made two conditions obligatory for the permissibility of eating: the first is that the blood flows, and the second is mentioning the name of Allah. So whoever slaughters a sacrificial animal and does not mention the name of Allah upon it, whether out of forgetfulness or intentionally, eating it is forbidden, as mentioned in the verse and the hadith. As for the fact that the one present said the takbir for him, this is not sufficient. First, because he did not mention the name of Allah for the one present. Second, because the mention of the name must be from the one who directly performs the slaughter. It is not valid for it to be from one who did not directly perform it. Do you see if a person is with another, and the other wants to pray, and the first one says the takbir of intention for him? Does this second person enter into the prayer because the first one said the takbir for him? No. In any case, the mention of the name on the sacrificial animal must be from the one who directly performs the slaughter, and whoever does not mention the name, his sacrificial animal is forbidden. Yes.

The questioner : If he was forgetful?

The Shaykh : Whether he was forgetful or ignorant, because the forgetful one, who is the slaughterer, is excused in that he forgot and did not mention the name of Allah. But the eater, who is forbidden from eating what the name of Allah was not mentioned upon, is not excused. Yes.
